Carter Appointees as Feisty as Ever Legal Pad,[link widoczny dla zalogowanych]
Court of Appeals,[link widoczny dla zalogowanych], naming 11 judges in just a few years. More than three decades later,[link widoczny dla zalogowanych], three of those appointees -- Stephen Reinhardt,[link widoczny dla zalogowanych], Harry Pregerson and Mary Schroeder -- are still active judges,[link widoczny dla zalogowanych], helping make up the liberal wing of the court. We caught up with them at the Ninth Circuit conference in Carlsbad. Later in the week,[link widoczny dla zalogowanych], look for a video interview with Schroeder.
Taking a short walk with Harry Pregerson can be a lengthy endeavor. Not just because the 87-year-old takes careful steps aided by a cane. He also likes to stop and shake hands,[link widoczny dla zalogowanych], slap backs and swap stories with just about anyone and everyone he sees along the way.
At a conference with dozens of old friends and colleagues he doesn often get to see in person,[link widoczny dla zalogowanych], that can mean a very short stroll to lunch turns into quite an affair.
"Come on,[link widoczny dla zalogowanych], Harry,[link widoczny dla zalogowanych]," says Central District Senior Judge Terry Hatter as his old friend stops again.
Finally seated,[link widoczny dla zalogowanych], Pregerson ready to get down to business -- the business of entertaining a reporter questions. policy that rips families apart and sends children raised in the United States back to Mexico or elsewhere -- somewhere where they don feel they belong -- when a parent gets deported. He talks about cases he sees in which an otherwise law abiding mother who entered the country illegally goes to a lawyer to try and get legal help,[link widoczny dla zalogowanych], only to end up on the feds radar.
He has doubts about the quality of representation for some of the undocumented immigrants,[link widoczny dla zalogowanych], but on that issue,[link widoczny dla zalogowanych], he offers to send literature to illustrate that point,[link widoczny dla zalogowanych], rather than speak on the record.
Hatter reminds him there are immigrants engaged in violent criminal activity -- kids "out there gang banging," the former prosecutor says.
"Some are,[link widoczny dla zalogowanych]," Pregerson says.
Stephen Reinhardt wants to return to a time when court rulings were about substance and not so much about,[link widoczny dla zalogowanych], as he sees it now,[link widoczny dla zalogowanych], procedure.
"So many judges these days are proceduralists,[link widoczny dla zalogowanych]," he says sitting under an umbrella at a resort restaurant. The Supreme Court focus on procedural rules -- like on standing,[link widoczny dla zalogowanych], ripeness and mootness -- increasingly "keep people from vindicating their rights," he says.
